Why I want to leave the once Great State of California

This just in from what was once the best state in the Union:

Guess which state has the highest poverty rate in the country? Not Mississippi, New Mexico, or West Virginia, but California, where nearly one out of five residents is poor.

That’s according to the Census Bureau’s Supplemental Poverty Measure, which factors in the cost of housing, food, utilities and clothing, and which includes non cash government assistance as a form of income.

Given robust job growth and the prosperity generated by several industries, it’s worth asking why California has fallen behind, especially when the state’s per-capita GDP increased approximately twice as much as the U.S. average over the five years ending in 2016 (12.5%, compared with 6.27%).

The Left’s first, last and only instinct is to throw more money at the problem, but California’s already done that. and guess what?

It’s not as though California policymakers have neglected to wage war on poverty. Sacramento and local governments have spent massive amounts in the cause.

Several state and municipal benefit programs overlap with one another; in some cases, individuals with incomes 200% above the poverty line receive benefits.

California state and local governments spent nearly $958 billion from 1992 through 2015 on public welfare programs, including cash-assistance payments, vendor payments and “other public welfare,” according to the Census Bureau. California, with 12% of the American population, is home today to about one in three of the nation’s welfare recipients.

The generous spending, then, has not only failed to decrease poverty; it actually seems to have made it worse.

The progressives who control every aspect of the state’s government are not necessarily stupid people, but they are malign.

They understand that increasing welfare spending only encourages the arrival of more recipients on whom to spend it, and the high likelihood that those new constituents will vote Democrat as soon as they are able, legally or otherwise.

Already, some 55 percent of “immigrants” receive means-tested benefits, while only 30 percent of native Californians do so.

California’s army of bureaucrats contributes as well, as does the state’s highly restrictive land-use ordinances and environmental restrictions, which drive up the cost of housing in what is already the nation’s most expensive real-estate market:

With 883,000 full-time-equivalent state and local employees in 2014, California has an enormous bureaucracy.

Many work in social services, and many would lose their jobs if the typical welfare client were to move off the welfare rolls.

Further contributing to the poverty problem is California’s housing crisis. More than four in 10 households spent more than 30% of their income on housing in 2015.

A shortage of available units has driven prices ever higher, far above income increases. And that shortage is a direct outgrowth of misguided policies.

They’re not “misguided” — in fact, they’re doing exactly what the progressives designed them to do.

Higher housing prices means more money in the pockets of Angelenos and San Franciscans when they go to sell, high energy prices have a disproportionate impact on the poor, generous welfare “benefits” mean an endless supply of new Democrats and permanent employment for the public-employee unions who actually run the state.

It’s a perfect racket, and one that will continue unless and until the California Republicans get their act together and begin vigorously contesting what has become a one-party state designed to enrich those at the top, beggar the middle class, and keep those on the bottom in permanent penury.

THE TRANS WOMEN TURNING TO FIREARMS FOR SURVIVAL

On November 7th, a progressive flood at the polls gave some on the political left hope for 2018: Communities across the nation elected trans women, refugees, immigrants, and others who have historically been shut out of the political process.
But not all marginalized communities are hopeful, and even among those who are, survival is still imperative. Some progressive communities have responded to worries about their safety with a tactic that some on the left might find surprising, perhaps even counterproductive: They’re taking up arms.
Trans women are one such community. For some trans guns rights activists, arming trans women is a moral imperative in a society that routinely fails to protect them from systemic violence.
Their work sits at the intersections of a sometimes awkward divide—some are left-leaning, some are on the right, and all of them cherish an individualistic interpretation of gun rights.
This flies in the face of assumptions people may make about the trans community’s political leanings and feelings about the Second Amendment.
Being transgender can be extremely dangerous, and trans people don’t view the social structures ostensibly intended to defend people from harm as safe for them—law enforcement, for example, has a record of abusing trans women and disbelieving trans women when they report crimes.
This is particularly true for trans women of color, who are made doubly vulnerable by society, especially those in the sex industry.
For trans women feeling alone against the world, armed self-defense can start to feel like a very appealing option, though sometimes a frightening one.

I was so traumatized by guns by my 30s that it took three very patient queer gun instructors in a private living room to coach me through my first firearms training,” says Scout Tran-Caffee, a non-binary trans woman and multidisciplinary artist from Northern California.
Whether women are pursuing training and licensure for the purpose of accessing conceal carry permits, or spending time with fellow LGBT people on the range to learn more about gun safety and fire a variety of weapons, gun ownership can also create a sense of solidarity and community.
Kayla Harris, an Oakland-based woman who started out with LGBT gun rights organization Pink Pistols before splitting away to form the Rouge Rifles with a colleague, has been a gun owner for a very long time.
But it wasn’t until the election that she started exploring the possibility of supporting fellow LGBT people who wanted to learn more about guns. “After the [Pulse] shooting and after the election, I knew tons of people who were suddenly interested in guns who never had been before,” Harris says.
Harris carried her interest in firearms through transition, and is a certified firearms instructor—one reason she pursued and maintained her certification was a desire to give back to her community. “Gun owners shouldn’t just default to the white guy who lives in Wisconsin or whatever,” she says. “That’s not the only person who should own guns. For disadvantaged and marginalized people, it equalizes force.”
Harris’ casual interest in guns and enjoyment in shooting shifted as she transitioned and adapted to the Trump era. In an age when the federal government appears to be making war on the trans community, emboldening people on a local level, her fears are rooted in practicality. “There are countless stories of people who failed to be neutralized by a less than lethal weapon,” she says.
That’s her driving desire in educating people about firearms, with a focus on home defense (conceal carry permits are extremely difficult to obtain in the Bay Area). She knows not all trans women agree with her work, but she wants to provide access to trans-inclusive, safe, supportive firearms training for those who are interested.
Often, she loans out her own weapons on the range for training purposes, giving people an opportunity to see if shooting is for them before plunging into buying a gun—and dealing with the demands of storing it safely and in a legally compliant fashion.
Though Harris supports gun education and ownership for trans women who feel it’s a good fit for their needs, she does have a word of caution.
“If I as a trans woman ever shoot a right-wing fascist, the law is almost definitely not going to be on our side,” she comments, noting that law enforcement agencies have a long history of prosecuting marginalized people who fight back. While stand-your-ground laws may be a defense for white cis men, a fatal encounter could go very differently for a trans woman, and Harris has no illusions about the implications.
“When I teach a defense class, the point of the class is to kill someone,” Harris says. “If you’re a trans woman, the person you’re killing is likely to be someone society values more than you.”
Whether the National Rifle Association would step up in defense of a trans woman—especially a trans woman of color—who shoots and kills in self defense is an open question.
When 32-year-old Philando Castile was shot and killed by law enforcement in Minnesota, the NRA failed to condemn the incident, despite the fact that Castile had a conceal carry permit, something critics said may have played a role in his death.
Harris, and Tran-Caffee, hope a test of the NRA’s limits will never come; firing a gun anywhere other than the range or an organized sport shoot isn’t something either woman relishes.
“I dream of how trans peoples’ daily lives could change if all our bullies came to assume that we were all jiu jitsu blackbelts or else had concealed carry licenses,” says Tran-Caffee, who also participates in martial arts training at Oakland’s Four Elements Fitness, where she’s worked to make the gym more LGBT-friendly.
In the face of people who are afraid to leave their homes and be themselves because they fear physical assault that might be difficult to stop with the use of non-lethal means, the fight over gun control gets much more complicated, and perhaps it should. The lack of nuance in conversations about what form gun control should take, and what the founders intended with the Second Amendment, may do a disservice to both sides.

Student protester hit by car as she blocked freeway sues UC San Diego
The University of California-San Diego is now embroiled in a personal injury lawsuit after an election protest gone wrong.
Mariana Flores, a sophomore at UCSD, was demonstrating against Donald Trump’s victory on a busy San Diego freeway when a vehicle hit her. The accident crushed her pelvis, fractured her leg, and caused other serious injuries, reported The Guardian campus newspaper.
Flores, in her suit filed in late November, partly blames campus officials for her injury, arguing they should have stopped the protest before it got dangerous, according to news reports.

Flores’ attorney did not respond to requests from The College Fix seeking comment. A UC San Diego spokesperson said that the university could not comment on pending litigation.
The Nov. 2016 protest had began at “Library Walk” and journeyed through campus. Next, demonstrators ended up on the I-5, a very large and busy eight-laned freeway that cuts through San Diego.
The car that stuck Flores had gotten around an emergency vehicle that had been attempting to block traffic so authorities could shut down the freeway, according to the Los Angeles Times.
In an interview with The Guardian, Gene Sullivan, Flores’s lawyer, asserted that the university planned, organized and knew the protest was happening for hours and did nothing to stop it.
“According to Sullivan, not doing anything and failing to act is legally the same thing as supporting the protest,” the newspaper reported. “Sullivan further alleged that the protest was encouraged by people in positions of authority at the university, and that ‘if anyone that is in authority with the university – a [Residential Advisor] – says ‘let’s go,’ the university would be responsible.’”
The complaint also lists the University of California Regents, the city and county of San Diego, the state of California, and the driver of the vehicle as defendants in the lawsuit.
When asked about the lawsuit by the Los Angeles Times, Sullivan said “We think it’s a case of shared responsibility of the school, Maria and the driver, and we’re not saying that anybody is without fault or fault-free. We think other people bear some responsibility as well.”
In addition, Sullivan explained that if any person representing the university, even if that person is simply a Residential Advisor, encouraged students to go to the protest, then the university would bear responsibility.
While Sullivan admits that Flores is partially responsible for her injuries, he claims that, under the doctrine of comparative responsibility, the jury will get to decide what percentage of the injury is the fault of the plaintiff and what percentage of the injury is the fault of the defendant. Damages will be levied based on percentage.
The lawsuit seeks attorneys’ fees, court costs, and unspecified damages, the Times reports.

L.A. County Issues Carry Licenses to the Well-Connected, Skirts Own Policies

With 42 states and the District of Columbia now recognizing the Right-to-Carry, California’s retrograde may-issue Carry Concealed Weapon licensing regime is atypical.

However, a recent state audit of three of California’s CCW license issuing authorities shows that Los Angeles County does operate much like another large jurisdiction, New York City, when it comes to granting licenses.

That is, licenses are reserved for the well-connected and officials don’t bother to follow the rules when issuing them.

Under California law, a sheriff of a county may issue a CCW license to an applicant upon receiving proof,

(1) The applicant is of good moral character.

(2) Good cause exists for issuance of the license.

(3) The applicant is a resident of the county or a city within the county, or the applicant’s principal place of employment or business is in the county or a city within the county and the applicant spends a substantial period of time in that place of employment or business.

(4) The applicant has completed a course of training as described in Section 26165.

Statute does not further define “good moral character” or “good case,” which gives a local sheriff’s department significant discretion to determine the criteria necessary to acquire a permit in their jurisdiction. 

Los Angeles County has a written Concealed Weapons Licensing Policy that elaborates on what the sheriff’s department considers sufficient “good cause” to merit a license. The policy states,

good cause shall exist only if there is convincing evidence of a clear and present danger to life, or of great bodily harm to the applicant, his spouse, or dependent child, which cannot be adequately dealt with by existing law enforcement resources, and which danger cannot be reasonably avoided by alternative measures, and which danger would be significantly mitigated by the applicant’s carrying of a concealed firearm.

Moreover, the policy makes clear that “No position or job classification in itself shall constitute good cause for the issuance, or for the denial, of a CCW license.” 

It is exceedingly difficult for a law-abiding citizen to meet Los Angeles County’s criteria for a CCW license. Los Angeles County has issued 197 licenses to its 10.2 million residents. This works out to about 1 license for every 50,000 residents.

The audit, conducted by the California State Auditor, researched samples of 25 CCW licenses issued by three sheriff’s departments, Los Angeles County, Sacramento County, and San Diego County.

For Los Angeles, the auditors concluded that the county “did not completely adhere to its policies when issuing any of the 25 CCW licenses we reviewed.” The researchers also determined, “Los Angeles issued all but one of these licenses without the level of documentation it expects to demonstrate that the applicant has met the good cause requirement.”

Rather than require the level of documentation for “good cause” outlined in their policy, Los Angeles County simply granted licenses to the well-connected. The auditors found the following,

22 of the 25 CCW licenses we reviewed were issued to applicants with professions that connected them to the law enforcement community: the individuals were former or current law enforcement officers, judges, court commissioners, retired federal agents, and deputy district attorneys.4

In fact, we found that of the 197 licenses that Los Angeles had issued that were active as of mid-August 2017, only nine were issued to applicants outside of that community.

As pointed out earlier, Los Angeles County’s written policy states that “No position or job classification in itself shall constitute good cause for the issuance, or for the denial, of a CCW license.”

The auditor’s report shares the story of a Los Angeles County Superior Court judge who did not provide information of a personal threat to his safety on his license application, as required under county policy.

This judge was granted a license. The report then contrasts this case with that of a worker who stated that he wanted a license because “he worked in undesirable and remote areas and carried large amounts of cash.” This individual’s application was denied. The audit report called Los Angeles County’s practices judging “good cause” for issuing licenses “inequitable.”

The auditors also found that Los Angeles County failed to obtain requisite documentation concerning some licensees’ residency, “moral character,” and training.

In contrast to Los Angeles County, the Sacramento County Sheriff’s Department has a more lenient policy concerning “good cause.”

At the direction of Sheriff Scott R. Jones, Sacramento considers self-defense or the defense of other sufficient to meet the “good cause” requirement.

This has resulted in far more permits being issued in Sacramento County than Los Angeles County. With a population of 1.5 million, Sacramento County has 9,130 CCW license holders.

Sacramento County’s shall-issue carry regime is part of what prompted the state audit.

In a letter responding to the auditor report, Jones explained that following the failure of legislation put forward by NRA F-rated Assemblymember Kevin McCarty that would have made it more difficult for ordinary Californians to acquire CCW licenses statewide.

The Assemblymember targeted Sacramento and other shall-issue carry jurisdictions for retribution. Jones’s letter notes, “Assemblymember McCarty threatened on social media on December 21st, 2016, to use the legislative audit function to intervene in my and others’ CCW permit processes because of his legislative failures. This audit is a consummation of that threat.”

However, the audit didn’t come to McCarty’s desired conclusions. The state auditor did not recommend that his legislation be adopted. Further, concerning Sacramento’s policy, the auditor report explained,

Although we believe the differences between Sacramento’s criteria for good cause and the criteria of the other two departments are most likely the reason for the higher number of licenses it issued during the period we audited, we cannot conclude that a higher rate of license issuance is necessarily a harmful effect of local discretion.

The California State Auditor’s office was right to describe Los Angeles County’s permitting procedure as “inequitable.” May-issue licensing regimes have always been ripe for this type of abuse.

In the early 20th century, New York’s Sullivan Law was used to prohibit immigrants from owning handguns. In the 1950s, civil rights leader Martin Luther King Jr. was denied a carry permit in Alabama.

This year, officials from the New York City Police Department’s License Division were indicted on federal corruption charges for what amounted to selling handgun licenses. 

Members of Los Angeles County’s law enforcement community should be able to exercise their Right-to-Carry for the defense of themselves and others.

However, the county’s law-abiding residents should have that same opportunity. Until California and the small handful of holdout jurisdictions join the 21st century and respect the Right-to-Carry, these abuses will continue.

Of course, given ongoing federal litigation and legislative efforts on the Right-to-Carry, sometime soon the regressive politicians of these backwards enclaves may no longer have a say in the matter.

Necessity is the mother of invention, right?  No one knows that better than Californians.
Over the years the state has passed law after law infringing on their right to keep and bear arms.  But with every turn of the screw, Californians have fought back, finding new workarounds that allow them to maintain some semblance of their 2A rights while vexing anti-gunners in the process.
With 2018 around the corner.  Here are some examples of what Californians are doing to stick it to their overlords in Sacramento.
Law: No more Online Ammo Sales (2018), Background Checks for All Ammo Sales (2019)
 Workaround: Buy ammo out of state.  Simple as that.  For Californians who live along border states like Arizona, Nevada, and Oregon it’ll be relatively easy.  For everyone else, it might be a long car ride.  Still, go for a road trip.  Buy in bulk.  And be done with it. Don’t give them the satisfaction or the tax revenue from purchasing from California vendors. Sorry California ammo sellers, you’ll have to take one for the team on this.
Law: Bullet Button Ban (2018)
Workaround: The Bullet Button was a workaround against the state’s initial ban on black rifles with detachable magazines, telescoping stocks, flash hiders, and pistol grips. It’s a simple device that secures a magazine to a rifle so that it cannot detach without the use of a tool (or tip of a bullet) to disengage it.
Lawmakers caught on to the Bullet Button and banned it.  As part of that legislation, they are requiring current owners with a bullet button on their rifle to register it with the state.  Heck no!  To escape this nonsense, just remove the Bullet Button and add a Patriot Pin.
A Patriot Pin circumvents the law because with the device installed a user cannot detach a magazine without opening the action.  The beauty of the Patriot Pin is that it’s a rapid way to open the action and, thus, release the mag.  Basically, with the push of a button.

Workaround: Suppose you don’t want to go the route of the Patriot Pin or the Bullet Button. There is a way to have a rifle with a detachable magazine.  The tradeoff is you can’t have any features.  No collapsing stock, no flash hider, no pistol grip.
The solution is a featureless rifle.  An AR with a funky-looking non-pistol grip, a fixed stock and no flash hider.  They’re ugly.  Hideous compared to standard ARs.  But they’ll get the job done.  What’s more, it is yet another way to flip off the powers that be.

Workaround: While the state legislature passed this law, the decision on whether it applies to various areas is actually up to the local counties.  Convince the board members in your county not to enact the new rule and it won’t take effect.  Easier said than done if you live outside of counties like Los Angeles or San Diego.  Nevertheless, give it a go.

Young People Say Calling Them a ‘Snowflake’ Damages Their Mental Health

A new survey reveals that young people believe being called a “snowflake” could be damaging to their mental health.

A new survey by insurance firm Aviva found that 72 percent of 16 to 24-year-olds believe the term “snowflake” is unfairly applied to millennials.
74 percent of respondents took it a step farther, arguing that they believe the use of the label could have a negative effect on young people’s mental health.
The study was born out of interest in the term “snowflake generation” which was originally used to describe young people who thought they were unique or special. Some suggest it was popularized by a line in the 1996 novel Fight Club and its 1999 film adaptation: “you are not special, you are not a beautiful and unique snowflake.”
The word’s meaning eventually evolved to mean “overly-sensitive.” It is often used to describe college students who claim that they are offended by controversial or even mundane ideas.
Chuck Palahniuk, the author of Fight Club, has embraced the rise in popularity of the term. “There is a kind of new Victorianism,” he said. “Every generation gets offended by different things but my friends who teach in high school tell me that their students are very easily offended.”

Dr. Doug Wright argues that because young people are more likely to experience mental health issues than older generations, they are especially susceptible to damage as a result of usage of the “snowflake” label.
“Our findings suggest that young adults are more likely to be experiencing mental health problems, so using a phrase which criticizes this age group could add to this issue,” he said. “Any term used disparagingly to a segment of the population is inherently negative.”

“While young adults in particular appear to take offence to the ‘snowflake’ label, the majority of adults agree that the term is unfair and unhelpful, so it’s important that people consider how such labels are used, and the cumulative effect they could have on their recipients,” he finished.
